13-8-12. Prohibited uses of open space.

(1) Uses of open space shall not include the following:

(a) roads;

(b) parking lots that occupy more than 15% of the open space;

(c) dwellings;

(d) commercial uses; or

(e) land set aside for use that solely benefits any one person or entity.

(2) The instrument for permanent protection shall include clear restrictions on the use of the open space. (Ord.2005-21, 09/6/05)
